Military Leave of Absence

Adopted by Spokane Public Library Board of Trustees on March 21, 2017.

1. GENERAL

This policy is divided into the following sections:

2. STATEMENT OF POLICY

Spokane Public Library is committed to protecting the job rights of employees absent on military leave.  In accordance with federal and state law, it is the Library’s policy that no employee or prospective employee will be subjected to any form of discrimination on the basis of that person’s membership in or obligation to perform service for any of the Uniformed Services of the Unites States.  Specifically, no person will be denied employment, reemployment, promotion, or other benefit of employment on the basis of such membership.  Furthermore, no person will be subjected to retaliation or adverse employment action because such person has exercised his or her rights under this policy.  If any employee believes that he or she has been subjected to discrimination in violation of this policy, the employee should immediately contact the Human Resouces Director, the Executive Director, or their Manager.

3. MILITARY LEAVE

In compliance with the laws of Washington State every employee who is a member of any organized reserve or armed forces of the United States shall be entitled to and shall be granted paid military leave for a period not exceeding twenty-one (21) working days during each year beginning October 1 and ending the following September 30 in order that the person may report for active duty, when called, or take part in active training duty.

4. MILITARY LEAVE OF ABSENCE

Employees directed to participate in extended military duties in the U.S. Armed Forces that exceed twenty-one working days will be placed on a military leave of absence status for a period of as long as five years and will be entitled to all rights and benefits guaranteed by the Federal Uniformed Services Employment and Reemployment Rights Act (USERRA).

5. ADMINISTRATION

The Board grants full authority to Library Administration to develop and administer rules, processes and procedures in regard to Military Leave and Military Leave of Absence that comply with the law and are consistent with this policy.
